Permanent Residence in Chile: Apply for the Residencia Definitiva
The Residencia Definitiva turns Chile's logic around: first real presence, then lifelong freedom, as the status only lapses after more than two years of continuous absence.
Who this procedure suits
Permanent residence fits you if your temporary residence in Chile is already running: the Residencia Definitiva is the second stage of the system, not the entry point. Eligibility depends on your nationality, and we check it before you order. It suits everyone who has built Chile into a real home and now wants the status that protects that investment: valid for life, with no renewal cycles and a minimal presence requirement. And it is the mandatory stop for anyone aiming at naturalisation after 5 years, because without the Residencia Definitiva there is no Chilean passport. The smart move is to place the presence-heavy build-up phase inside the 3 to 6 year tax window: your foreign income stays protected while you build up the time for permanent residence and the passport.
And who it does not suit:
- ✕You do not yet hold temporary residence in Chile: your path starts with the Residencia Temporal, not here.
- ✕You are not willing to live in Chile during the build-up phase: longer absences delay the conversion, and Chile has no presence-free fast track.
- ✕You are looking for a permanently tax-free status: once the tax deferral ends, Chile taxes worldwide income at progressive rates up to 40%; if you want 0% on foreign income for good, you are better off in Paraguay or Panama.
Requirements
You can apply for the Residencia Definitiva after 12 or 24 months of temporary residence, depending on your situation; the usual case is around two years. The authority wants to see a genuine connection to the country: the 24-month route is open only if you have been away for no more than two months in total, and more absence extends it to 30, 36 or 48 months. Add a clean record and evidence of orderly finances. Important under the strict migration law: the application must be filed in good time before your temporary status expires, around 90 days before as a rule of thumb, because missed deadlines can cost you your status. Which evidence your situation actually needs is checked for your case before you apply.

Processing and follow-up
The authority reviews, the team on the ground follows up, and we keep you informed in English until the resolution is issued.
- 5
Status for life
Once approved, the Residencia Definitiva is valid for life; from then on we only track the absence rule and, if you wish, the 5-year deadline for naturalisation.
How long it takes
From filing to resolution, typically several months pass; the Chilean migration authority is thorough and not known for speed. The most important lever comes before filing: complete documents, correctly apostilled and translated, filed in good time before your temporary status expires. There is no guaranteed date.
Do you need to be there in person?
Chile is honestly demanding here, and then honestly generous. In the build-up phase you should keep your absences short: the 24-month route allows no more than two months away in total, and anyone who travels too much delays the conversion. After the grant the logic flips: the Residencia Definitiva is valid for life and only lapses after 2 years of continuous absence; if you need to stay away longer, you can extend once by a further 2 years through the Chilean consulate, applying 60 days before the deadline. Keep the tax side in mind: living in Chile through the build-up phase quickly takes you past the 183-day threshold for tax residence, and that is exactly where the 3 to 6 year deferral for new residents comes in.
Family members coming with you
Your spouse or partner and children each go through the conversion with their own set of documents, and we handle the coordination. Chile prices minor and adult dependants differently: both are separate items in your quote, so the difference also exists in the effort the procedure takes; you see the details transparently in your quote. It makes sense to convert the whole family in the same window, so that statuses, and later the naturalisation deadlines, stay in step.
What comes next
The Residencia Definitiva begins Chile's best chapter: a minimal presence requirement, full status in the country, and the 5-year clock towards naturalisation keeps running, because temporary and permanent residence count together from your first residence permit. At the end stands the strongest passport in Latin America, the only one in the region with the US Visa Waiver. We handle naturalisation as a separate procedure; the background is in our guide to Chilean citizenship and on the Chile country page.
What is not included
- •Government fees in Chile
- •Apostilles and legalisations in your home country
- •Certified translations
- •Notary fees
- •Travel and living costs
- •The proof of income and assets itself
- •Tax advice in the destination country
Tax note
Residence is not the same as tax residence. Chile taxes tax residents on worldwide income in principle, but gives new residents a deferral: 3 years on Chilean-source income only, extendable on application to the SII to up to 6 years, after which worldwide income is taxed at progressive rates up to 40%. If you place the presence-heavy build-up phase inside this window, you build up the time for permanent residence and the passport while your foreign income stays protected. How Chile's window compares with Uruguay and Ecuador is in tax holidays compared; your individual case belongs with a tax adviser.
One point of contact, from start to finish
Your application is filed together with our local partners, licensed attorneys in each country, with whom we have worked for years. We coordinate your case, check your documents and remain your point of contact: in English, throughout.
That applies whether you are still at home or already on the road: one point of contact, no language barrier, no loose ends across four time zones.
Frequently asked questions
When can I apply for the Residencia Definitiva?+
After 12 or 24 months of temporary residence, depending on your situation; the usual case is around two years. Timing matters: file in good time before your temporary status expires, around 90 days before as a rule of thumb.
How many days do I need to spend in Chile?+
A lot before the conversion: you only make the 24-month route with no more than two months of absence in total, and more absence extends it to 30, 36 or 48 months (DS 296, article 65). After the grant the requirement is minimal: the status only lapses after more than 2 years of continuous absence.
Does the Residencia Definitiva ever expire?+
It is valid for life and only lapses after 2 years of continuous absence. If you are planning a longer absence, you can apply once for an extension of a further 2 years through the Chilean consulate, 60 days before the deadline.
Will living in Chile during the build-up phase make me taxable?+
You become tax resident with more than 183 days in any 12-month period, so the build-up phase usually crosses that threshold. That is exactly what the deferral for new residents is for: for 3 years, and on application up to 6, only Chilean-source income is taxed.
What about my family?+
Your spouse or partner and children convert with their own set of documents. Chile prices adult and minor dependants differently, and both are separate items; the details are set out transparently in your quote.
Does permanent residence lead to citizenship?+
It is the prerequisite. After 5 years of continuous legal residence, with temporary and permanent residence counting together, you can apply for naturalisation. You can also keep the Residencia Definitiva indefinitely without ever taking the passport.
Who runs my procedure?+
We run it together with our local partners, licensed attorneys in each country, aligned with the SERMIG system. We coordinate your case, track the deadlines and remain your personal contact, in English, throughout.
